1. Acceptance
By accessing or using the Bloom Platform operated by Bloom Software Services LLC ("we," "us"), you agree to these Terms of Service.
2. Platform Description
Bloom is a multi-tenant sales intelligence and lead management platform. Services include:
- Lead generation, enrichment, and scoring
- CRM and deal pipeline management
- AI-powered content generation
- Market research and competitive intelligence
- Territory management and canvassing tools
- Lead marketplace for buying and selling qualified leads
YouTube publishing
Bloom's YouTube connection and video publishing features use YouTube API Services. By using these features, you agree to be bound by the YouTube Terms of Service, in addition to these Bloom terms. You must have authority to connect the channel and the necessary rights to the videos you submit.
Review your selected channel, video, visibility and required content disclosures before confirming an upload. Connecting a channel alone does not publish content. YouTube may restrict, review or remove content under its policies. Disconnecting Bloom does not remove videos already uploaded to YouTube. Our Privacy Policy describes connection data, revocation and deletion requests.
Call Center minutes and optional natural voice
Calling plans use the prices shown and accepted at checkout. Receptionist and human calling time share the plan’s included minute pool; a transfer does not count the same time twice. Extra local numbers and minutes beyond the pool are billed at the accepted rates. Price changes do not rewrite usage or invoices from previous billing periods.
The standard AI receptionist voice has no additional voice charge. Turning on the optional natural voice requires acceptance of its per-minute price. Verified premium receptionist time appears as a separate monthly invoice line, in addition to the calling plan. Turning it off stops its use on new calls. Time that cannot be verified, including uncertain fallback time, is not charged as premium voice.
You must have the necessary rights and permission for any custom voice or recording. Bloom does not authorize cloning another person’s voice without their written consent.
3. Acceptable Use
You agree to:
- Comply with all applicable telemarketing laws (TCPA, TSR, state regulations)
- Scrub all call lists against the National Do Not Call Registry before outbound calling
- Obtain proper consent before contacting leads
- Honor all opt-out requests within 24 hours
- Not use the platform for spam, harassment, or illegal purposes
- Not attempt to bypass DNC scrubbing or compliance features
- Not resell raw data without proper data broker registration
You agree NOT to:
- Use lead data for purposes other than legitimate business outreach
- Contact numbers on the DNC registry without an established business relationship or express consent
- Falsify consent records or lead sources
- Use AI-generated content without proper disclosure
- Circumvent tenant isolation or access other tenants' data
4. Lead Marketplace
For Sellers
- Leads listed on the marketplace must be legitimately sourced
- All leads must be DNC-scrubbed before listing
- Lead quality grades (A/B/C/D/F) must accurately reflect data completeness
- Sellers are responsible for consent documentation for their leads
For Buyers
- Purchased leads are licensed for the buyer's business use only
- Buyers must independently verify DNC status before outbound calling
- No redistribution or resale of purchased leads without written permission
- Lead freshness is not guaranteed beyond the stated enrichment date
5. AI Content
- AI-generated content (Soul Videos, marketing copy, door tags) is labeled as such
- You are responsible for reviewing AI content before publishing or distributing
- AI-generated content may contain inaccuracies — verify before relying on it
- We do not guarantee that AI content is free of bias or errors
6. Data Accuracy
- We provide data "as-is" from public and third-party sources
- We do not guarantee the accuracy, completeness, or timeliness of enrichment data
- Lead scores and quality grades are algorithmic estimates, not guarantees of conversion
- Property data from county records may be outdated
7. Fees and Payment
- Subscription fees are billed monthly or annually as agreed
- Lead marketplace transactions are billed per-lead at listed prices
- Every text and email you send to your customers counts toward your plan's included amount; texts you receive do not. Past the included amount, extra texts are 1.5¢ per text, picture messages are 4.5¢ each (the price of 3 texts) and extra emails are 0.15¢ per email ($1.50 per 1,000), unless your plan or order form states a different price. Extra usage is totaled for each calendar month and charged after the month ends
- API usage beyond free tiers may incur additional charges from third-party providers
- Refunds for purchased leads are available within 7 days if data is materially inaccurate
8. Termination
We may suspend or terminate accounts that:
- Violate these Terms or applicable law
- Generate excessive DNC complaints
- Engage in spam or harassment
- Fail to pay fees when due
Upon termination, your data will be retained for 30 days, then deleted unless legally required to retain.
9. Limitation of Liability
To the maximum extent permitted by law, Bloom Software Services LLC shall not be liable for indirect, incidental, special, or consequential damages arising from use of the platform, including but not limited to lost profits, DNC violations, or regulatory fines.
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify Bloom Software Services LLC against claims arising from your:
- Violation of telemarketing laws
- Misuse of lead data
- Failure to scrub against DNC lists
- Unauthorized use of AI-generated content
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.
12. SMS / Text Messaging Programs
Customers operating recruiting workspaces on the Bloom Platform (for example, AlignSalesPros) may send transactional text messages to job applicants through the program identified as AlignSalesPros / Bloom Recruiting Notifications. By opting in you agree to the following terms.
Program description and message types
The program sends applicant-related transactional messages only, including: one-time verification codes, interview scheduling links, interview reminders, hiring status updates, and onboarding next steps. We do not send marketing or promotional text messages through this program.
Opt-in is separate and optional
SMS consent is collected through a separate, optional, pre-unchecked checkbox on the job application form. Checking it is never a condition of applying, of employment, or of any purchase or service. You may submit your application and use all services without opting in to text messages.
Frequency, rates, and carrier disclosures

- Message and data rates may apply.
- Carriers are not liable for delayed or undelivered messages.
How to get help or opt out
- Reply STOP to any message to unsubscribe at any time. After you send STOP, we will send one confirmation message and then stop sending texts.

Bloom Internal Ops Alerts
Authorized Bloom employees and operators may opt in through the authenticated Settings → Notifications control to receive recurring automated operational messages from Bloom Software Services LLC about platform health, service degradation, recovery, queues, and systems they support. SMS is off by default, and a saved mobile number alone does not enroll a recipient. The complete workflow and exact disclosure are available on the public Bloom Internal Ops Alerts review page.

Bloom Work Alerts
Invited call-floor representatives may separately opt in to recurring automated work-alert texts from Bloom Software Services LLC through authenticated onboarding or Settings → Notifications. This program sends phone verification codes and notices about assigned leads, floor updates and follow-ups. It does not send marketing messages. A saved phone number, a floor invitation, or consent to another Bloom messaging program does not enroll you. Work alerts start only after you accept the separate disclosure and verify your mobile number.
- Consent is optional and is not required to use Bloom or complete account setup.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to unsubscribe, or turn off work texts in Settings → Notifications.
- Reply HELP for help, or email mo@getbloom.cloud.
- Replying START after STOP does not enroll you again in Bloom; enable and verify work texts in your account.
- Carriers are not liable for delayed or undelivered messages. Text delivery depends on sender availability and current access to the work.
